These Terms of Service govern your engagement of Beyond Structural Engineering Pty Ltd (ABN 96 702 114 448) (“we”, “us” or “our”) and your use of our website at https://beyondstructuralengineering.site. By engaging our structural engineering services or using this website, you agree to these terms.
1. About our business
Beyond Structural Engineering Pty Ltd provides structural engineering services from Perth, Western Australia, including structural design, documentation, inspections, assessments, certifications and reporting for residential and commercial projects. Our services are delivered in accordance with applicable Australian Standards, the National Construction Code and the laws of Western Australia.
2. Quotes and engagement
- Quotes provided by us are valid for 30 days from the date of issue unless otherwise stated in writing.
- A binding engagement arises only when you accept a quote in writing and any requested deposit or retainer has been paid.
- Quotes are based on the information you provide at the time of enquiry. If the scope, site conditions or documentation differ materially from that information, we may issue a revised quote before proceeding.
- Fees for variations to the agreed scope will be advised in writing and must be approved by you before the variation work is undertaken.
3. Fees, invoicing and payment
- Fees are payable in Australian dollars in accordance with the payment terms stated on our invoices.
- Invoices not paid by the due date may attract interest and reasonable recovery costs.
- Disbursements reasonably incurred in delivering the services (such as external consultant fees) may be on-passed at cost where stated in the quote.
- If you have a dispute about an invoice, please contact us first so we can work through it with you.
4. Your obligations
You agree to provide accurate and complete information relevant to the engagement, including site access, existing documentation, survey data and any known site conditions. You confirm that you are authorised to commission work at the relevant site. Delays caused by incomplete information or restricted access may affect timeframes and costs.
5. Deliverables and reliance
- Deliverables (including drawings, calculations, reports and certifications) are prepared for you and for the specific project and purposes identified in the engagement.
- Deliverables must not be amended, reproduced or relied upon by any other party or for any other project without our prior written consent.
- Where a regulatory authority requires our documentation, reliance terms may be formalised in a reliance deed at our discretion.
6. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. To the extent we are permitted to limit our liability under the Australian Consumer Law, our liability for a breach of a consumer guarantee is limited, at our option, to the supplying of the services again or the payment of the cost of having the services supplied again.
7. Professional standards and liability
- We perform our services with the due care and skill expected of a competent professional engineering practice, and we maintain appropriate professional indemnity insurance.
- To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your use of deliverables outside the agreed scope or purpose.
- Our total liability for any claim arising out of an engagement is limited to the fees paid for the relevant services, except where liability cannot lawfully be limited.
8. Intellectual property
All deliverables, methods and documentation prepared by us remain our intellectual property. Upon full payment, you receive a perpetual, non-exclusive licence to use the deliverables for the agreed project and purposes. You retain ownership of information and documents you supply to us.
9. Confidentiality and privacy
We keep your project information confidential and use it only to deliver our services and comply with legal obligations. Our handling of personal information is described in our Privacy Policy.
10. Suspension and termination
Either party may terminate an engagement by written notice if the other party materially breaches these terms and the breach is not remedied within 14 days. You may also terminate for convenience by written notice, in which case fees for work performed to the date of termination remain payable. We may suspend services if invoices remain unpaid beyond the stated terms.
11. Governing law
These terms are governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of Western Australia and applicable Commonwealth courts.
12. Changes to these terms
We may update these terms from time to time. The current version published on this website applies to new engagements from the date of publication. Continued use of our services after an update constitutes acceptance of the revised terms.
